Property Documents Checklist — India Buyer Guide

Documents Checklist helps buyers, sellers, NRIs, renters and home-loan applicants organise a working property file. Choose your role, state and property type, track collected records, find issuing sources and missing-document actions, and download a free PDF. Title, approvals, identity, dues and financial records depend on the transaction and local rules. The checklist is a starting point for your lawyer or lender, not an exhaustive legal opinion or proof of clear title.

How do I use the Documents Checklist?

  • Role-based folders for buying, selling, renting, NRIs and home loans
  • Separate sections for identity, title, approvals, dues and funds
  • Sources and recovery actions for missing documents
  • Pair with Legal Help to engage a property lawyer
  • Free for unlimited use

Build your property document folder in four steps

  1. Choose your role and context. Select buyer, seller, NRI, loan applicant, under-construction buyer or renter, then state and property type. Confirm local applicability separately.
  2. Work through each divider. Tick only records actually collected. Keep conditional items unticked until an adviser or lender confirms applicability.
  3. Recover missing records. Open the missing-document guidance for the issuing source and a practical next action.
  4. Share a working file. Review timing assumptions and download the free PDF for your family, lawyer or lender. No document uploads are requested.

Three folders. Three different starting points.

Illustrations computed with the same role lists, rounded progress and longest-pending-task method. Parallel requests assumed. Indicative · Oct 2026 · not legal advice.

Kolkata · buyer

Pune · salaried home loan

Property records collected; financial and lender documents remain. 9 of 14 listed items collected. Stress case: 14 × 2 + 14 = 42 days; not an upper limit: 64% · 14 retrieval days

Bengaluru · under-construction

Identity, title and project records collected; contract and receipts still open. 12 of 15 listed items collected. Stress case: 7 × 2 + 14 = 28 days; not an upper limit: 80% · 7 retrieval days

What questions does the Documents Checklist answer?

What documents are required to buy a property in India?

Start with the registered ownership deed, title chain and relevant searches, agreement terms, acceptable identity and tax records, and applicable approvals, dues and lender releases. Occupancy, completion, RERA, inheritance, society and land-use records depend on the property and jurisdiction. Your lawyer determines the search period and final list; Aadhaar is not the only possible identity proof.

What is an encumbrance certificate and why does it matter?

An EC or relevant registration search reports recorded transactions or charges within the searched period and jurisdiction. It may not reveal unregistered claims, every dispute or all liabilities. It is one part of due diligence, not proof of clear title or absence of mortgages. Ask a lawyer to set the scope and period.

What is the difference between OC and CC?

A completion certificate generally concerns completion in accordance with approved plans; an occupancy certificate generally concerns permission to occupy. Local law determines names, issuing authority and applicability. Do not assume both are universally required for every resale registration or that an application is an issued certificate.

Is RERA registration mandatory for resale properties?

A resale transaction does not by itself determine the parent project’s RERA obligations. Check project area, apartment count across phases, completion status, statutory exemptions and state rules with your lawyer and the relevant authority. Registration alone does not establish title or compliance with every approval.

What documents does a builder give the buyer at handover?

Request the possession and payment records, executed agreements and conveyance documents, applicable occupancy or completion records, maintenance and defect-liability terms, utility details and relevant association or society records. The exact documents and timing depend on the contract, project and local law.

Do I need a NOC from the housing society?

Society transfer forms, dues statements, share certificates and any NOC depend on the applicable state law, society structure and bye-laws. A NOC is not a universal title guarantee or proof that no litigation exists. Confirm requirements and current processing times with the society and your lawyer.

How long should I retain property documents after purchase?

Permanently. Sale deed, all old chain-of-title documents, registration receipts and stamp-duty challans must be kept indefinitely — they protect against future title challenges and are required for any sale or loan.

What is the property mutation document?

Mutation records a change in relevant municipal or revenue entries following a transfer or succession. It does not confer title. Municipal tax mutation and land-record mutation can be separate; confirm the authority and process locally. In West Bengal, relevant khatian or record-of-rights entries and KMC tax records, where applicable, serve different administrative purposes.

What documents are required for a salaried home loan?

Start with identity and address proof, PAN or applicable alternatives, salary slips, Form 16, bank statements and filed tax returns, alongside property papers requested by the lender. Periods and acceptable alternatives vary by lender.

What if the original sale deed is missing?

Ask the relevant sub-registrar about certified copies and engage a property lawyer about the loss, local process and possible claims. A copy alone does not resolve missing-original risks or guarantee lender acceptance.

Can I download a property documents checklist PDF?

Yes. The free PDF includes your selected role, state, property type, collection status, sources, indicative retrieval assumptions and missing-item guidance. No login or document upload is needed.

Does 100% progress mean the property is legally clear?

No. It means you marked the listed records collected. It does not establish authenticity, applicability, clear title, absence of disputes or lender acceptance. Have your adviser review the originals.
